These Terms and Conditions of Sale (TCS) govern the relationship between the customer (hereinafter referred to as “the Customer”) and the restaurant Délices de Simone, located at the address provided below, for any orders or reservations made through our website or via other remote means.

1. About Us

Délices de Simone is an independent French restaurant established in 2020, offering seasonal, homemade cuisine inspired by the traditions of the Côte d’Azur. We operate exclusively from our single location in Nice.

2. Purpose

These Terms and Conditions set out the terms under which orders, reservations, payments, and (where applicable) takeaway or pickup services are carried out by Délices de Simone.

3. Menu and Availability

All dishes offered by Délices de Simone are those listed on our in-house or online menu, subject to availability. The menu is updated regularly to reflect seasonal products and the chef’s inspiration.

Photos and descriptions are for illustrative purposes only and may not precisely reflect the final dish served.

4. Orders

Dine-In

Orders placed while dining at the restaurant are taken directly by our staff.

Takeaway (if applicable)

Orders for takeaway may be placed via telephone or through our website. The Customer agrees to collect the order at the agreed time.

Once confirmed, all takeaway orders are final. Because our meals are prepared fresh, cancellations or refunds cannot be made after preparation begins.

5. Reservations

Customers may reserve a table via our website, by phone, or in person. Reservations are confirmed only after explicit acknowledgment (by email, SMS, or verbally).

Délices de Simone reserves the right to cancel or modify a reservation in the event of exceptional circumstances or force majeure.

6. Prices and Payment

All prices are listed in euros (€), inclusive of all applicable taxes (TTC). Prices may be updated at any time, but the Customer will always be charged the price in effect at the time the order or reservation was made.

Accepted payment methods include:

• Cash

• Credit/debit cards (Visa, MasterCard)

• Other methods as accepted in-store

7. Cancellations and Late Arrivals

If the Customer is more than 15 minutes late for a reservation without prior notice, the reserved table may be released.

To cancel a reservation, please inform us at least 2 hours in advance. Repeated or last-minute cancellations may result in a refusal of future bookings.

8. Liability

Délices de Simone is committed to providing high-quality service in full compliance with French health and safety standards.

We cannot be held responsible for any damage or inconvenience resulting from improper use of our products or services, or from customer negligence.

9. Personal Data

Customer data collected for orders or reservations is used strictly for operational and communication purposes. In accordance with the French Data Protection Act and GDPR, Customers have the right to access, correct, or delete their personal data by contacting us.

10. Governing Law

These Terms and Conditions are governed by French law. In case of dispute, both parties will first seek an amicable resolution. If unsuccessful, the matter will be referred to the competent courts.
